Necessary documents for the invitation in purpose of employment

Necessary documents for the invitation in purpose of employment, the conferment and the extension of the right to work for immigrant workers, border and seasonal workers.

In order to obtain a favorable notice, the employer shall submit a request to the National Employment Agency, with the argumentation of the necessity to invite the foreign citizen, his qualification and the place of work, the personal data of the foreign specialist (name, surname, day, month and year of birth, citizenship), passport data (series, number, validity), length of service. To the request are annexed the following documents:

a)     registration of job vacancies and the copy of the announcement;

b)    copies of documents on incorporation of enterprise/organization/institution (registration certificate, excerpt from the State Register of Enterprises and Organizations);

c)     copy of the education certificate or another document that confirms the qualifications of the specialist, invited to work, translated into the state language and authorized in accordance with the requirements of the Convention abolishing the Requirement of Legalization for Foreign Public Documents;

d)    individual employment contract. 

To receive the right to work for the immigrant worker, the employer or its representative, empowered in accordance with the legislation in force, shall submit the following documents:

a)     request of the enterprise/organization/institution to the National Employment Agency concerning the conferment of the right to work;

b)    a questionnaire – application of the immigrant worker;

c)     a copy of the positive notice issued by the National Employment Agency;

d)    copies of documents on incorporation of the enterprise/organization/institution (enterprise registration certificate, excerpt from the State Register of Enterprises and Organizations, activity authorization/license (if needed));

e)     documents that confirm the enterprise activity (certificate from the Tax Inspectorate on lack of debts to the national public budget, copy of the financial statement for the last reporting period, if this exceeds 3 months);

f)      individual employment contract, in original;

g)     foreign citizen’s national ID card or the stateless person’s ID card with the appropriate imprints about state border crossing in accordance with the legislation in force and its copy;

h)     copy of the education certificate or another document that confirms the qualifications of the specialist who was invited to work, translated into the state language and authorized in accordance with the requirements of the Convention Abolishing the Requirement of Legalization for Foreign Public Documents;

i)       medical certificate of the required form and the medical certificate that confirms that he person is HIV/AIDS-negative, in original;

j)       document that confirms the existence of dwelling space for the requested period (owner’s declaration/leasing contract/sales contract);

k)     1 recent color photo (50×60 mm), on a light and uniform background;

l)       criminal record from the country of origin, translated into the state language and authorized in accordance with the requirements of the Convention Abolishing the Requirement of Legalization for Foreign Public Documents.

To extend the right to work for a new term, the employer or its representative, empowered in accordance with the legislation in force, shall submit the following documents:

a)     the request of the enterprise/organization/institution to the National Employment Agency concerning the extension of the right to work;

b)    copy of the permit for temporary stay for labour purposes;

c)     copies of documents on incorporation of the enterprise/organization/institution (enterprise registration certificate, excerpt from the State Register of Enterprises and Organizations, activity authorization /license (if needed));

d)    documents that confirm the enterprise activity (certificate from the Tax Inspectorate on lack of debts to the national public budget, copy of the financial statement for the last reporting period, if this exceeds 3 months);

e)     individual employment contract, in original;

f)     foreign citizen’s national ID card or the stateless person’s ID card and its copy;

g)     medical certificate of the required form and the medical certificate that confirms that the person is HIV/AIDS-negative, in original;

h)     document that confirms the existence of dwelling space for the requested period (owner’s declaration/leasing contract/sales contract).

 

Necessary documents for the conferment and the extension of the right to work for the managers of economic units.

In order to confer the right to work to the foreign citizen/stateless person who have set up an enterprise/organization/institution, to its manager, the associate or the shareholder with a leading function within the enterprise/organization/institution, the following documents are submitted:

a)     the request of the enterprise/organization/institution, addressed to the National Employment Agency concerning the conferment of the right to work, with the indication of the qualification of the foreign citizen and the place, where he will exert his functions, personal data (name, surname, day, month and year of birth, citizenship), passport data (series, number, validity) length of service;

b)    a questionnaire-application of the immigrant worker;

c)    copies of documents on incorporation of the enterprise/organization/institution (enterprise registration certificate, excerpt from the State Register of Enterprises and Organizations, activity authorization/license (if needed));

d)    documents that confirm the enterprise activity (certificate from the Tax Inspectorate on lack of debts to the national public budget, copy of the financial statement for the last reporting period, if this exceeds 3 months);

e)    the individual employment contract, in original;

f)     the foreign citizen’s national ID card or the stateless person’s ID card with the appropriate imprints about state border crossing in accordance with the legislation in force and its copy;

g)   the medical certificate of the required form and the medical certificate that confirms that the person is HIV/AIDS-negative, in original;

h)    document that confirms the existence of dwelling space for the requested period (owner’s declaration/leasing contract/sales contract);

i)       1 recent color photo (50×60 mm), on a light and uniform background;

j)       criminal record from the country of origin, translated into the state language and authorized or with apostil in accordance with the requirements of the Convention Abolishing the Requirement of Legislation for Foreign Public Documents.

For the extension for a new term of the right to work, the employer or its representative, empowered in accordance with the legislation in force, shall submit the following documents:

a)     the request of the enterprise/organization/institution, addressed to the National Employment Agency for the extension of the right to work;

b)    the copy of the permit for temporary stay for labour purposes;

c)     the copies of documents on incorporation of the enterprise/organization/institution (enterprise registration certificate, excerpt from the State Register of Enterprises and Organizations, activity authorization/license (if needed));

d)    the documents that confirm the enterprise activity (certificate from the Tax Inspectorate on lack of debts to the national public budget, copy of the financial statement for the last reporting period, if this exceeds 3 months);

e)     the individual employment contract, in original;

f)      the foreign citizen’s national ID card or the stateless person’s ID card and its copy;

g)     medical certificate of the required form and the medical certificate that confirms that the person is HIV/AIDS-negative, in original;

h)     the document that confirms the existence of dwelling space for the requested period (owner’s declaration/leasing contract/sales contract).

Necessary documents for the invitation in purpose of employment, the conferment and the extension of the right to work to detached workers.

  To receive the positive notice for detachment, the enterprise from the Republic of Moldova shall submit a request to the National Employment Agency, with the argumentation of the necessity to detach the foreign specialist, with the indication of the terms of works, his qualification and the place where he will exert his functions. To the request are annexed the following documents:

a)    registration of the offer of vacancies;

b)   copies of documents on incorporation of the enterprise/organization/institution (enterprise registration certificate, the exert from the State Register of Enterprises and Organizations, activity authorization/license (if needed) );

c)     copy of the educational certificate or another document that confirms the qualifications of the specialist who was invited to work, translated into the state language and authorized in accordance with the requirements of the Convention Abolishing the Requirement of Legalization for Foreign Public Documents;

d)    copy of the work and/or service contract, concluded by the legal entity from the Republic of Moldova and the foreign legal entity, translated into the state language, which shall include the following:

- clause stipulating that the works will be performed by detached workers;

- detachment conditions;

- the term of the fulfilment of the works;

- specialties of the detached persons;

- number of detached persons.

For the conferment of the right to work to the detached worker, the enterprise/organization/institution or its representative, empowered in accordance with the legislation in force, shall submit the following documents:

a)     the request of the enterprise/organization/institution, addressed to the National Employment Agency concerning the conferment of  the right to work;

b)    questionnaire-application of the detached worker;

c)    copy of the positive notice of detachment, issued by the National Employment Agency;

d)    copies of documents on incorporation of the enterprise/organization/institution (enterprise registration certificate, excerpt from the State Register of Enterprises and Organizations, activity authorization/license (if needed));

e)     documents that confirm the enterprise activity (certificate from the Tax Inspectorate on lack of debts to the national public budget, copy of the financial statement for the last reporting period);

f)      copy of the work and/or service contract, concluded by the legal entity from the Republic of Moldova and the foreign legal entity;

g)     decision on the detachment of the foreign specialist from a foreign employer –legal entity;

h)     the foreign citizen’s national ID card or the stateless person’s ID card with the appropriate imprints about state border crossing in accordance with the laws in force and its copy;

i)       copy of the educational certificate or another document that confirms the qualifications of the specialist who was invited to work, translated into the state language and authorized or with apostil in accordance with the requirements of the Convention Abolishing the Requirement of Legalization for Foreign Public Documents;

j)       medical certificate of the required form and the medical certificate that confirms that the person is HIV/AIDS-negative, in original;

k)     document that confirms the existence of dwelling space for the requested period (owner’s declaration/leasing contract/sales contract);

l)       1 recent color photo (50×60 mm), on a light and uniform background;

m)  criminal record from the country of origin, translated into the state language and authorized or with apostil in accordance with the requirements of the Convention Abolishing the Requirement of Legalization for Foreign Public Documents.

In order to extend for a new term the right to work for the detached worker, his employer or representative, empowered in accordance with the legislation in force, shall submit the following documents:

e)     the motivated request of the enterprise/organization/institution, addressed to the National Employment Agency for the extension of the right to work;

f)      copy of the permit for temporary stay for labour purposes;

g)     copies of documents of incorporation of enterprise/organization/institution (enterprise registration certificate, excerpt from the State Register of Enterprises and Organizations, activity authorization/license (if needed));

h)     documents that confirm the enterprise activity (certificate from the Tax Inspectorate on lack of debts to the national public budget, copy of the financial statement for the last reporting period);

i)       copy of work and/or service contract, concluded by the legal entity from the Republic of Moldova and foreign legal entity;

j)       the foreign citizen’s national ID card or the stateless person’s ID card and its copy;

k)     medical certificate of the required form and the medical certificate that confirms that the person is HIV/AIDS-negative;

l)       document that confirms the existence of dwelling space for the requested period (owner’s declaration/leasing contract/sales contract).
